How ownership works
Foreigners can't hold freehold. There are clear alternatives.
Indonesian freehold title (Hak Milik) is reserved for Indonesian citizens. International buyers typically use one of these legal routes, and the right one depends on your residency, plans and budget:
| Leasehold (Hak Sewa) | A long-term lease agreed with the landowner and signed before a notary/PPAT. Open to any foreigner with a passport; your protection is in the contract terms (length, extension, transfer). |
|---|---|
| Right of Use (Hak Pakai) | A registered title available to foreigners holding a KITAS or KITAP residence permit, subject to minimum-value rules. |
| PT PMA company + HGB | A foreign-owned Indonesian company holding a Right to Build (HGB). Often used where you plan to rent the property commercially, which requires the appropriate licences. |
Nominee arrangements (title held in an Indonesian's name for you) are not offered and are strongly discouraged.
